A Providence man is in jail after being arrested last Tuesday on charges of first degree rape and first degree sodomy.

John David Waters, 29 of Providence, was arrested by the Caldwell County Sheriffs Department on Tuesday after a warrant for his arrest was issued following an investigation by the Kentucky State Police. 

The investigation was conducted by KSP trooper Jerrod Hearld.

Details of the crimes, the investigation and the arrest were not released, and the KSP had not responded to inquiries as of press time.

First degree rape, a class B felony, is charged when sex with the victim is forced, or when the victim is someone who is not capable of consenting to the act because they are either physically helpless or are less than 12 years old.

Winters appeared in Webster County District Court on Tuesday and entered a plea of not guilty. The plea a formality as district court does not handle felony cases. He will next appear in a preliminary hearing in Webster County District Court on Tuesday at 10:00 a.m.

If enough evidence is found, the case will then go before the grand jury.
